1. About these terms

This website is operated by Gelato Time (ABN 93 161 427 934) ("we", "us", "our"). These terms apply when you use gelatotime.com.au or place an order with us. By using the site or placing an order, you agree to them. If you don't agree, please don't use the site.

2. Our products

Gelato Time sells gelato and sorbet mixes for at-home gelato makers. You'll need a gelato maker such as a Ninja™ CREAMi™ or nutribullet Chill™ to make them. Please follow the directions on the back of each sachet.

Allergen information is on each product page and printed on every pack. Please check it before you buy and before you make it.

Some product images are digital renders. The packaging you receive may look slightly different, but the product inside is the same.

Ninja™, CREAMi™, nutribullet™ and Chill™ are trademarks of their respective owners. Gelato Time is not affiliated with, endorsed by or sponsored by the makers of those machines.

3. Prices and payment

All prices are in Australian dollars (AUD) and include GST. Prices can change at any time, but the price you pay is the one shown at checkout when you place your order.

If a product is listed at the wrong price, we'll contact you before your order ships. You can then go ahead at the correct price or cancel for a full refund.

Payment is taken in full at checkout, including for pre-orders.

4. Your order

When you place an order, we'll email you an order confirmation. Your order is accepted when that confirmation is sent, subject to section 8 below.

Please check your delivery address and contact details before you submit. If something needs correcting, email us as soon as possible and we'll do our best to update it before your order ships.

5. Pre-orders

Some products are sold on pre-order. Pre-orders are charged at checkout and ship from the date shown on the product page, in your cart and in your order confirmation.

If the ship date changes, we'll email you with the new date. You can then choose to wait or cancel for a full refund.

6. Shipping

We ship anywhere in Australia. We don't ship overseas yet. Shipping costs are shown at checkout and on our Shipping page.

Delivery times are estimates only and can be affected by our delivery partners. We'll email you when your order is on its way. Once your order has been delivered to the address you gave us, it's your responsibility.

7. Cancelling an order (by you)

You can cancel your order at any time before it ships. Email info@gelatotime.com.au with your order number and we'll refund you in full, including any shipping you paid.

Once your order has shipped, our Refund policy applies.

8. Cancelling an order (by us)

We may cancel all or part of an order before it ships if:

  • the product is no longer available
  • there's an error in the price or product description
  • we can't deliver to the address provided
  • we reasonably suspect the order is fraudulent or misuses a promotion
  • the order breaches these terms

If we cancel, we'll let you know by email and refund what you paid for the cancelled items in full.

9. Promotions and discount codes

Discount codes and offers are subject to the conditions stated with them. Unless we say otherwise, only one code can be used per order, codes have no cash value and can't be applied after an order is placed.

First-order offers, such as free shipping on your first order, can be used once per customer, on a first order only. We may change or end a promotion at any time, but this won't affect orders already placed.

10. Your consumer rights

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

Nothing in these terms excludes, restricts or changes any right or remedy you have under the Australian Consumer Law. See our Refund policy for how to make a claim.

11. Gelato makers

We don't sell gelato makers. Any warranty or support for your machine is provided by its manufacturer, so please contact them directly about any issue with your machine.

12. Liability

We provide the information on this site in good faith and try to keep it accurate and up to date. To the extent permitted by law, and without limiting your rights under the Australian Consumer Law, we're not liable for any indirect or consequential loss arising from your use of this site.

13. Your account

You can check out as a guest or sign in to an account. If you sign in, you're responsible for keeping access to your email account secure. We handle your personal information in line with our Privacy policy.

14. Content and trademarks

All content on this site, including text, design, graphics, illustrations and images, belongs to Gelato Time or is used with permission. You can view, download and print it for your own personal use and to place orders with us. Any other use needs our written permission.

15. Other websites

This site may link to websites run by others. We're not responsible for their content or availability.

16. Changes to these terms

We may update these terms from time to time. The version on this page when you place an order is the one that applies to that order.

17. Governing law

These terms are governed by the laws of New South Wales, Australia.
